Terms of Use

1. Acceptance of Terms

By accessing or using VividCV ("the Service"), operated by VividHR ("we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. These terms apply to all users including individuals, companies, and recruitment agencies.

2. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One account per person or organisation unless otherwise agreed in writing.
  • You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Upload content that infringes intellectual property rights or contains malicious code.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Resell, sublicense, or otherwise commercialise access to the Service without our written consent.
  • Use AI-generated scores as the sole basis for employment decisions without human review.
  • Discriminate against candidates on protected characteristics using the Service.

4. Candidate Data & Employment Law

You are responsible for ensuring your use of VividCV complies with applicable employment law, data protection legislation, and anti-discrimination law in your jurisdiction. AI-generated scores are a screening aid only. Final hiring decisions must involve human judgement. You must not use the Service to unlawfully discriminate against candidates on the basis of age, disability, gender, race, religion, sexual orientation, or any other protected characteristic.

5. Free Trial

New accounts receive a free trial allowing one job specification, up to 30 candidate CVs, and one AI analysis. The free trial is intended for evaluation purposes. We reserve the right to modify or terminate the free trial at any time. Abuse of the trial (e.g. creating multiple accounts to extend trial access) will result in account termination.

6. Subscriptions & Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or at our sole discretion. You authorise us to charge your payment method on the billing cycle you select. We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

7. Intellectual Property

VividCV and its contents, features, and functionality are owned by VividHR and protected by intellectual property law. You may not copy, modify, distribute, or reverse engineer any part of the Service. You retain ownership of the content you upload (job specs, CVs). By uploading content, you grant us a limited licence to process it solely to deliver the Service.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that AI analysis results are accurate, complete, or fit for any particular purpose. AI scores are a tool to assist — not replace — human hiring judgement.

To the maximum extent permitted by law, VividHR shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any hiring decisions made on the basis of AI analysis results.

9. Termination

We may suspend or terminate your account at any time for breach of these terms, fraudulent activity, or at our discretion with reasonable notice. You may cancel your account at any time from Settings. Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
